Binding Agreement & Site Use
Binding Legal Contract
PLEASE READ CAREFULLY. This is a binding legal agreement between Window Rock Modern ("Owner," "we," or "us") and the individual accessing this site or booking a stay ("Guest," "you"). By accessing this Site or continuing with a reservation, you agree to every term and condition herein. If you do not agree, please discontinue use immediately.
Site Content & Intellectual Property
All content, photography, and branding displayed on this Site are the property of Window Rock Modern. The downloading, reproduction, or re-transmission of this information for commercial use is strictly prohibited without prior written consent.
Trademarks
"WINDOW ROCK MODERN," "THE WINDOW ROCK," and all related logos and branding are proprietary trademarks. No license to use these trademarks is granted to the Guest or any Site visitor.
Section 02
Booking, Payments & Cancellations
Legitimate Reservations
You agree to make only legitimate, good-faith reservations for your own use and your invited guests. Reselling, re-posting, or transferring reservations on any third-party site is strictly prohibited. A reservation is confirmed only upon receipt of full payment or a valid payment authorization through our direct booking platform or an approved third-party platform (Airbnb, VRBO).
Cancellation Policy
30+ days prior to arrival: 100% refund of the total reservation cost.
14–29 days prior to arrival: 50% refund of the total reservation cost.
Less than 14 days prior to arrival: No refunds will be issued.
Payment Processing
Refunds may take 7–10 business days to appear on your statement. We recommend purchasing third-party travel insurance for unforeseen medical or travel disruptions.
Inaccuracies & Fraud
We reserve the right to cancel or modify reservations where it appears a user has engaged in fraudulent activity or if a reservation contains a manifest error in pricing or availability. In such cases, the Guest will receive a full refund of any amounts paid.
Section 03
Occupancy & Use
Guest agrees to use the Property solely as a temporary private residence. The maximum occupancy is limited to the number of guests declared at the time of booking. Undisclosed guests are a violation of this Agreement and may result in immediate termination of the reservation without refund.
No parties, weddings, receptions, or commercial events (including photo/video shoots, corporate retreats, or any revenue-generating activity) are permitted without prior written consent from the Owner. Subleasing, subletting, or re-listing the Property on any platform is strictly prohibited.
The minimum age for the primary guest (the person whose name appears on the reservation) is 25 years old. Maximum occupancy is strictly enforced and displayed on each property's booking page.
Section 04
Nature & Safety (The Bluff)
Both properties are situated on or near bluff edges at approximately 2,000 feet elevation. Due to the extreme terrain and the inherent risk of the Bluff, Window Rock Modern is an adult-focused retreat. We do not allow children between the ages of one (1) and twelve (12). Infants (under 1 year) may be considered only with prior written consent and an additional signed waiver.
Guests must remain within designated railed areas at all times. Climbing on, over, or beyond safety barriers, railings, or fencing is strictly prohibited and constitutes an immediate breach of this Agreement. The Owner reserves the right to terminate the reservation without refund if this rule is violated.
The bluff terrain is unimproved and may include loose rock, uneven ground, exposed roots, and steep drop-offs with no barriers. Conditions change rapidly with weather. Exercise extreme caution at all times, especially after rain, in fog, or in low-light conditions. Guests should carry a flashlight after dark.
Section 05
Smoking & Vaping
This is a 100% smoke-free and vape-free property. Smoking or vaping of any substance — including tobacco, cannabis, e-cigarettes, or any similar product — is strictly prohibited inside the home and on all wooden deck surfaces.
Violation will result in an immediate $500 deep-cleaning fee, plus the full cost of any professional restoration required (including but not limited to upholstery cleaning, odor remediation, and air filtration servicing). This fee will be charged to the payment method on file without further notice.
Section 06
Animals
We comply fully with all ADA requirements regarding service animals. If you are traveling with a documented service animal, please notify the Owner in advance so we can make any necessary accommodations.
Emotional Support Animals (ESAs) and pets are not permitted due to the high-end nature of the furnishings and the allergen-free environment maintained for all guests. To preserve this environment for every visitor, unauthorized animals on the Property will result in a minimum $500 cleaning and remediation fee.
Section 07
Hot Tub & Soaking Tub Safety
The A-Frame 7-ft Alaskan Cedar Hot Tub
Use of the cedar hot tub is entirely at the Guest's own risk. The hot tub is constructed of natural Alaskan cedar, which requires specific care. The following rules apply without exception:
Guest must shower before entry to preserve the water chemistry of the cedar tub. No glass, food, soaps, oils, or lotions are permitted in or around the hot tub. The hot tub cover must remain closed and buckled with straps when not in active use. Children must be supervised at all times in and around the hot tub area.
Guest releases the Owner from any liability regarding skin irritation, illness, or injury resulting from hot tub use. Guest agrees to be responsible for any damage caused by a failure to follow these guidelines, including staining, chemical imbalance requiring draining and refilling, or physical damage to the cedar.
Jackson Point Ofuro-Style Cedar Soaking Tub
The same care guidelines apply to the Japanese-inspired cedar soaking tub in the Wellness Room. Additionally, the 14-foot sliding doors adjacent to the tub must not be left fully open during freezing temperatures. Guest is responsible for any weather-related damage resulting from doors left open.
Section 08
Care of Interiors
Guest agrees to treat the custom cabinetry, Mid-Century Modern furniture, designer finishes, and specialized stone/wood surfaces with extreme care. These are not standard rental furnishings — both properties feature custom millwork, natural stone, curated designer pieces, and hand-selected materials.
Any stains, scratches, burns, or damage beyond reasonable wear and tear will be billed at the full cost of professional restoration or replacement. Guest will be provided with photographic evidence and an itemized invoice for any damage claim. Guest agrees that the payment method on file may be charged for damage costs up to 30 days after checkout.
Specifically: no candles or open flames (other than the provided fire pit and fireplace), no tape or adhesives on walls, no rearranging of heavy furniture, and no use of hair dye, self-tanner, or similar staining products on linens or upholstery.
Section 09
Quiet Hours & Noise
While both properties are private and secluded, Guest agrees to maintain reasonable noise levels at all times. Quiet hours are observed from 10:00 PM to 8:00 AM. Amplified music audible beyond the property boundary is not permitted at any time.
Both properties have neighbors at a distance. The Owner reserves the right to address noise complaints and, in extreme cases, to terminate the reservation without refund.
Section 10
Check-In, Check-Out & Key Return
Check-in and check-out times are specified in the booking confirmation. Late check-out without prior approval may result in a fee of up to one additional night's rate. Guest is responsible for returning the Property in a reasonably clean and orderly condition — dishes washed or loaded, trash bagged, thermostat returned to the setting noted in the house guide, and all doors and windows secured.
Failure to return keys, access devices, or any provided equipment (telescope, fire pit tools, etc.) will result in a replacement fee.
Section 11
Assumption of Risk
Guest acknowledges that the Property is located in a rugged, mountainous environment featuring steep bluffs, uneven terrain, varying weather conditions, limited cell service in some areas, and potential encounters with local wildlife including but not limited to bears, snakes, coyotes, and insects.
Guest and all associated parties stay at the Property entirely at their own risk. The Owner has taken reasonable precautions to maintain the safety of the Property, but cannot guarantee the absence of all hazards in a natural mountain environment.
Section 12
Indemnification
Guest agrees to assume all liability for any injuries, illness (including but not limited to those related to hot tub use, hiking, or exposure to natural elements), damages, death, or losses incurred by Guest or any associated third party while on the Property or traveling to/from the Property.
Guest agrees to indemnify, defend, and hold harmless Jonathan Parkhurst (Owner), their agents, employees, contractors, and representatives from any and all claims, demands, lawsuits, or causes of action arising out of or related to Guest's stay, including attorney's fees and court costs.
Section 13
Specific Waiver (The Bluff)
Guest specifically acknowledges and agrees that the bluff on which the Property is located is inherently dangerous. Guest assumes all risks associated with the proximity to the cliff edge, including but not limited to falls, rockslides, unstable terrain, and exposure to wind and weather.
Owner assumes no responsibility for injuries, death, or property damage resulting from the terrain, weather conditions, wildlife encounters, or the failure of the Guest to exercise reasonable caution. This waiver extends to all members of the Guest's party and any visitors.
Failure to remain within designated railed areas constitutes a breach of this Agreement and may result in immediate termination of the stay without refund.
Section 14
Limitation of Liability
To the maximum extent permitted by law, the Owner shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of enjoyment, emotional distress, or any damages arising from the use of or inability to use the Property.
In the event of any dispute, the maximum amount of damages recoverable by either party is limited to the total rental amount paid by the Guest for the specific stay in question. This limitation applies regardless of the legal theory under which damages are sought.
Section 15
Surveillance Disclosure
For the safety and security of the Property and its Guests, exterior security cameras are in operation at the following locations:
Both Properties
Front entrance and driveway.
The A-Frame
Deck area. The deck camera at The A-Frame may be disabled by the Guest when the hot tub is in use — instructions are provided in the house guide.
Jackson Point
Exterior patio and fire pit area.
No cameras are located inside either property. No audio recording is conducted at any time. Footage is retained for security purposes only and is not shared with third parties except as required by law or in the event of a property damage or security claim.
Section 16
Force Majeure
Neither party shall be liable for failure to perform obligations under this Agreement due to circumstances beyond their reasonable control, including but not limited to natural disasters, severe weather events, power outages, road closures, acts of government, pandemics, or civil unrest. In such events, the Owner will work in good faith with the Guest to reschedule or provide a reasonable refund.
Section 17
Arbitration, Class Action Waiver & Governing Law
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.
Binding Arbitration
Any dispute arising out of or related to this Agreement shall first be addressed through good-faith negotiation between the parties. If unresolved within thirty (30) days, the dispute shall be submitted to binding arbitration through the American Arbitration Association (AAA) in the jurisdiction of the Property (Tennessee).
Class Action Waiver
You hereby waive your right to a jury trial and your right to participate in any class action lawsuit or class-wide arbitration against the Owner. All disputes must be brought in an individual capacity only.
Section 18
Severability
If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
